General Terms and Conditions

A10, brokerage in concluding transactions, d.o.o., Popovičeva ulica 22, 1000 Ljubljana, which mediates, organises and carries out passenger transport, publishes the general terms and conditions of the GoCosy.si portal and the mediation or organisation of passenger transport by local carriers who are franchisees or licence holders of GoCosy. The General Terms and Conditions set out the conditions for the sale and purchase of brokerage and transport services, as well as the obligations and responsibilities of legal and natural persons as customers when ordering services and concluding contracts for transport and other services.

INTRODUCTORY PROVISIONS


 The General Terms and Conditions of Business (“General Terms and Conditions”) define the terms and conditions for the sale and purchase of transport brokerage and organisation services and the obligations and responsibilities of legal and natural persons as customers when ordering services and concluding contracts for transport and other services. On the basis of the
General Terms and Conditions, the parties agree on the rights and obligations of all contracting parties in a business relationship in which A10, Brokerage, Ltd. brokers, arranges and performs transport of persons.


GoCosy.si is a web portal and a trademark owned and operated by A10, brokerage d.o.o. The company was granted licence No 015088/BGD34-6-793/2023 for the provision of transport services in Slovenia by the OZS on 22 February 2023.


DEFINITIONS


GoCosy – is a company A10, Brokerage d.o.o., Popovičeva 22, 1000 Ljubljana, registration number: 8797781000, tax number: SI46492747, which brokers the transport of other carriers and also carries out its own transport. GoCosy always acts as an information broker and can act as a BROKER or a CARRIER.

 OTHER CARRIER – means a carrier with whom GoCosy does not have a contractual relationship and who is not involved in a contractual relationship with GoCosy.


TIME WINDOW – indicates the maximum number of hours between the actual time of the transport and the desired time of arrival or departure of the CUSTOMER.


 CUSTOMER – is the person, natural or legal, who orders and purchases the transport service offered by GoCosa and is the payer of the service and may also act as a PASSENGER.


 INTERMEDIATOR – is a legal entity that intermediates the transport service of another provider – the CARRIER and has access to the GoCosy
portal for the intermediation in accordance with the intermediation contract.


 PASSENGER – means the natural person who actually uses the transport service or the services provided in accordance with the General Conditions.

PASSENGER CARRIER – means the natural person who actually uses the transport service or the services provided in accordance with the General Conditions or is the representative of a group of passengers.


 CARRIER – is the provider of the passenger transport service in accordance with the Contract of Carriage and the General Conditions, who may also act as an INTERMEDIATE. The Carrier shall provide the transport service on its own account in accordance with the regulations on the carriage of passengers. The carrier must have a suitable vehicle and a properly equipped vehicle, as well as a driving licence and all other licences and permits necessary for the operation of the passenger transport service.


 CARRIAGE CONTRACT – is a contract where the CARRIER undertakes to transport the CUSTOMER or PASSENGER to a specified place and the CUSTOMER undertakes to pay the appropriate fare to the CARRIER. The
CONTRACT OF CARRIAGE is concluded when the CUSTOMER/PASSENGER confirms
on the website www.GoCosy.si that he/she has read and agrees to the General Conditions and makes the purchase.

 EARLIEST ARRIVAL
TIME – the last hour at which GoCosy is obliged to pick up and drop off the PASSENGER at the destination. Referred to on the Website as “EARLIEST ARRIVAL TIME”.


 TIME OF DEPARTURE – is the first hour when the PASSENGER is ready at the departure location for departure. On the Website, it is referred to as “DEPARTURE TIME”.


 VALUE CODE – is a credit of different values granted by GoCosy to the CUSTOMER in the various cases specified in these General Terms and Conditions. The VALUE CODE is valid for one (1) year from the date of issue. The VALUE CODE can only be used in full in one purchase, the balance cannot be transferred. GoCosy also does not pay the difference between the VALUE CODE and the purchase price.

 www.GoCosy.si – is the website through which the CUSTOMER submits the order, reservation and purchase for GoCosy transport.


FINDING TRANSPORT AND PRICE


The customer of the services on the GoCosy.si website is a natural or legal person who orders and pays for transport services. The subscriber may also act as a passenger. The subscriber must be a natural person of legal age or a legal person with full legal capacity.

A passenger on the GoCosy.si service can be a natural person of legal age. A passenger may act as a passenger carrier, who is a natural person of legal age and is responsible for the other passengers in the group. The Passenger Carrier certifies that he/she has the legal capacity to enter into the contract and has the authority to order the services on behalf of all passengers in the group.

In the process of booking the transport, the CUSTOMER must indicate whether it is a return transport, the number of PASSENGERS, the date of the transport and the TIME OF EARLIEST ARRIVAL or the TIME OF DEPARTURE. The price of the carriage is not fixed, but is determined on the basis of the demand for carriage on a specific route on a specific day and time. In the case of carriage to airports or other locations from where the PASSENGER continues the carriage by air or other carrier, the calculation of the desired TIME OF EARLIEST ARRIVAL or, in the case of a return journey, TIME OF DEPARTURE, is extremely important. This calculation must be made by the CUSTOMER/PASSENGER in the light of the times, instructions and requirements of the OTHER CARRIER. Taking into account the departure time of the OTHER CARRIER, the CUSTOMER/PASSENGER must determine for himself the last time to arrive at the departure location from which he continues his journey with the OTHER CARRIER, or the time at which he is expected to arrive at the location from which he continues his journey with GoCosy. The flight search engine on the GoCosy website, which compares the departure or landing time of the flight with the indicated time of the desired EARLIEST ARRIVAL or DEPARTURE TIME in accordance with the minimum average times between arrival at the airport and departure of the aircraft or landing of the aircraft and arrival at the airport building, is for information purposes only. GoCosy, the INTERMEDIATE and the CARRIER shall not be liable in the event of delays by OTHER CARRIERS, nor shall they be liable for any damages suffered by the CUSTOMER or the PASSENGER as a result of the use of an informative calculation or as a result of an incorrect estimate by the CUSTOMER/PASSENGER of the EARLIEST ARRIVAL TIME or the TIME OF DEPARTURE.


TYPES OF TRANSPORT


 After you have entered all the information, the GoCosy.si website will offer possible alternatives on that day at the desired times.


GoCosy offers three different types of transport with different restrictions and service characteristics:

VIP OFFER transport means transport at the CUSTOMER’s request, at the CUSTOMER’s requested times, from the address of the departure location to the address of the destination at the CUSTOMER’s request. The transport shall be exclusively for the use of the CUSTOMER or the named PASSENGERS of the CUSTOMER. If the TIME OF EARLIEST ARRIVAL is entered in the search engine, the carriage shall be scheduled to arrive at or before the specified time in the event of normal traffic conditions. The departure of the vehicle shall be determined by GoCosy according to the expected duration of the carriage. If the TIME OF DEparture is entered in the search engine, the departure of the vehicle shall be scheduled at that time and GoCosy, the INTERMEDIATE and the CARRIER shall not be liable for any delays to the destination. Transportation will be by comfortable VIP VEHICLE (type of vehicle will be selected according to the number of passengers).


COSY OFFER carriage means the carriage ordered by the CUSTOMER at the times desired by the CUSTOMER, from the address of the departure location to the address of the destination desired by the CUSTOMER. Other PASSENGERS may be added to the transport as determined by GoCosy. Short waits and stopovers at individual locations are possible. If the TIME OF EARLIEST ARRIVAL is entered in the search engine, the carriage shall be scheduled to arrive at that time or 15 minutes before or after the time specified. The departure of the Vehicle shall be determined by GoCosy according to the expected duration of the carriage. If the TIME OF DEPARTURE is entered in the Finder, the departure of the Vehicle shall be scheduled to depart at that time or 15 minutes before or after that time and GoCosy, the INTERMEDIATE and the CARRIER shall not be liable for any delays to the destination. When calculating the departure time, the CUSTOMER must take into account that the duration of the journey in the case of the COSY TRANSPORT OFFER is longer than in the case of the VIP TRANSPORT OFFER due to additional stops and detours. In the event of cancellation by the CUSTOMER, no refund is possible. In certain cases, GoCosy shall also offer the CUSTOMER alternative times of already confirmed transport at a known time, with an earlier arrival at the destination than the TIME OF EARLIEST ARRIVAL or a later departure than the TIME OF DEPARTURE. In the case of a COSY OFFER, the transport may in certain cases also be a scheduled service with specific departure and arrival times.


The FLEX SHIPPING OFFER is the most cost-effective service where GoCosy combines individual transport orders with the same routes and similar times. The pooling of PASSENGERS results in waiting and stopovers at individual locations (hotels, accommodation or home addresses). The departure/arrival times are adapted to the different needs of the CUSTOMERS who have booked the transport. GoCosy tries to combine orders in such a way that there are minimal deviations from the desired times. In the case of a FLEX SHUTTLE OFFER, it is up to the CUSTOMER to choose the appropriate TIMING according to his/her constraints and requirements. Each route shall have its own pre-set TIME SCHEDULE. In the first step of the search process, a price with a pre-set TIME SCHEDULE is always offered. If the CUSTOMER presses the “PRICE OPTIONS” button, he/she can choose between different flexibility options. In case of the LATEST ARRIVAL selection, the arrival may be up to so many hours before the EARLY ARRIVAL TIME, and in case of the DEparture TIME selection, the departure may be up to so many hours later than the DEPARTURE TIME. GoCosy shall be entitled to change the pre-set TIME SCHEDULE for any particular itinerary at any time and the CUSTOMER accepts this. The embarkation and disembarkation locations are fixed. These locations may be changed at an additional cost if desired. In the event of cancellation by the CUSTOMER, no refund shall be possible.


 Changes to the dates and times selected for bookings already confirmed and paid for the FLEX OFFER and COSY OFFER are not possible.


 In the case of a COSY OFFER or FLEX OFFER type of
carriage, the carriage may be carried out in cooperation with several CARRIERS, which means that the PASSENGER transfers between the vehicles and shifts the luggage.


BOOKING, PAYMENT AND CONFIRMATION


 Confirm the data entered:

The CLIENT or the ASSISTANT must confirm/select the correctness of the desired entry and/or exit point and, in the case of transport to or from the airport, verify the correctness of the selected TIME OF EARLIEST ARRIVAL or TIME OF DEPARTURE with the time of departure or landing of the aircraft or other means of transport. The CLIENT or the ASSOCIATE shall use the information of the OTHER CARRIER for the flight time. If this information is in any way inconsistent with the selected hour or TIME SCHEDULE of the transport ordered, it is the CLIENT’S/ASSISTANT’S responsibility to cancel the transport and make a new purchase via the online portal www.GoCosy.com.

 Even if the CUSTOMER/PASSENGER/CARRIER verifies the above and the system authorises the purchase, GoCosy, the ACCOMPANYER and the CARRIER shall not be held liable for the correctness of the selected arrival and departure times, as flight times vary and the airlines only inform the PASSENGERS of this.


 In the event that the customer indicates that he/she does not have a flight, GoCosy accepts no liability whatsoever in connection with any delay in arrival at the chosen destination.


 In case the Customer indicates that he/she does not have a flight, the CARRIER shall wait for the PASSENGER/E for a maximum of five minutes from the time indicated in the message.


 Step one:

In the first step, the CUSTOMER or the INTERMEDIATOR must enter the CUSTOMER’s details: first name, last name, mobile phone number, email address.

Step 2:

In the second step, the CUSTOMER or the ASSISTANT must enter the flight number if he/she is travelling to the destination.

In case more than one person is travelling together, only the name of the first PASSENGER needs to be entered, but the CARRIER can choose to enter his/her passengers next to him/her. If the CUSTOMER enters only the name of the first PASSENGER, then he/she is obliged to bring the list of passengers with him/her on the day of the journey and to hand it to the driver. If the CUSTOMER fails to do so, GoCosy shall not be obliged to provide the service until the written passenger list has been handed over to the driver. The first PASSENGER to be registered is the reservation holder, he/she is the only one who can modify the information and cancel the order for individual PASSENGERS or the whole carriage.

In this case, where one of the PASSENGERS is a child under 140 cm in height, the CLIENT or the ASSOCIATE must order and purchase a suitable child seat of the appropriate size for the height and weight of the child. If the CUSTOMER fails to do so, GoCosy and the CARRIER shall not be obliged to carry out the carriage either for the child or for his/her companion and shall not be liable for any damage caused to the CUSTOMER/PASSENGER/CARRIER as a result thereof.


 In the second step, the CLIENT or the ACCOMPLISHER must also check in baggage exceeding the dimensions entered and exceeding the quantities indicated and which the passenger is allowed to bring with him/her. The PASSENGER who is travelling, and any other requests for additional charges, shall be entered by the PASSENGER in the remarks. For more information on baggage and surcharges, please refer to Article 8 of these General Conditions.


 Step 3:

At the third step, the CLIENT or the RESELLER shall review all the information entered and selected and confirm that he/she agrees to these General Terms and Conditions and the Privacy Policy. GoCosy is not obliged to provide the Service to anyone who does not agree to these General Terms and Conditions and the Privacy Policy.


Step 4:

By accepting these General Terms and Conditions and the Privacy Policy, the CUSTOMER or the ASSISTANT proceeds to the next step, the payment, which is located on the secure server of the bank that provides the payment service for GoCosy, and where the payment is made by credit or debit card. Payment can be made with VISA, VISA Electron, MASTERCARD and MAESTRO, AMERICAN EXPRESS, GIROPAY, EPS, BANCONTRACT and iDEAL payment cards.


Some INTERMEDIATORS have a cooperation agreement with GoCosy or the CARRIERS, where payment by bank account on the basis of cumulative invoices is contractually agreed. These INTERMEDIATORS, by accepting the General Terms and Conditions and the Privacy Policy and by pressing the “next” button, make the purchase of transport without paying by credit or debit card. In cases where the INTERMEDIATOR does not make payment by credit card, the payment of the cumulative invoice of purchases shall be made by the INTERMEDIATOR as agreed in the contract between the INTERMEDIATOR and GoCosy or the CARRIER.


CONCLUSION OF THE CONTRACT


 Payment concludes the contract and confirms carriage. GoCosy undertakes that the carriage will be carried out by GoCosy or the CARRIER. GoCosy has the right, even after the conclusion of the contract, to offer the CUSTOMER a financial compensation in lieu of carrying out the carriage and to reimburse all costs incurred. In the event that the CUSTOMER accepts such an offer, GoCosy shall no longer be obliged to carry out the carriage.


GoCosy does not transport unaccompanied persons under 15 years of age or without the authorisation of a guardian, and does not transport animals without prior approval of GoCosy and without an escort.

PASSENGER INFORMATION AND TRANSPORT INFORMATION

The day before the departure of the booked transport, GoCosy sends a message to the mobile phone number and e-mail address of the PASSENGER with: the exact time of departure, the details of the CARRIER, the contact details of the driver, the type of vehicle and the location of the boarding point. In the event that the telephone or web network is not working, GoCosy accepts no responsibility for the lack of information of the PASSENGERS.

GoCosy also uses the mobile phone number or email address of the PASSENGER in case of urgent messages regarding the performance of the service. Due to unexpected changes, it is possible that GoCosy sends a subsequent/new message with new information about the time of transport, location, carrier and vehicle. The CUSTOMER/PASSENGER must take note of the most recent message.

GoCosy uses the information provided by the CUSTOMER or the PASSENGER. GoCosy shall not be held liable for the accuracy of the contact details provided, nor shall GoCosy, the INTERMEDIATOR and the CARRIER accept any liability for damages arising from the use of incorrect contact details provided by the CUSTOMER/PASSENGER.

PRTLJAGA

The PASSENGER is entitled, free of charge and without prior notice, only to small bags, pouches or clothes lighter than 4 kg and 1 piece of luggage with a maximum size of 40 x 23 x 55 cm and a maximum weight of 10 kg, and the PASSENGER is entitled to one piece of luggage up to 30 kg and dimensions 100x60x30 cm. All other luggage that is larger or special must be declared in advance in order for GoCosy to guarantee space in the vehicle. The price of each type of suitcase or package of different sizes and weights depends on the CARRIER, the vehicle and the route. At the purchase stage in step 4, once the CUSTOMER has correctly indicated the number and type of luggage, the system does not calculate the price of the additional luggage, but GoCosy sends a subsequent invoice for the additional luggage. If the weight and dimensions of the baggage exceed the values indicated by the CUSTOMER and the driver does not have enough space in the vehicle, the driver may refuse to carry such baggage. Bicycles and, in general, all luggage must be properly packed so as not to soil or damage the luggage of other passengers. In the event that additional luggage is not specified and charged for in advance at the time of booking, or is inadequately and improperly packed, the driver may refuse to carry such luggage if there is not adequate and suitable space in the vehicle for the safe carriage of passengers and luggage. In the event that the Baggage is suitably packed and there is space in the vehicle, GoCosy shall be entitled to charge for the carriage of such Baggage in excess of the weight declared.

Dangerous substances and objects such as: radioactive substances, explosives, flammable liquids, butane or propane gas cylinders, weapons, knives, poisons, corrosive substances, acids, magnets, substances containing viruses and bacteria, drugs are not allowed in the vehicle.

The DRIVER, the ASSISTANT, the CARRIER and GoCosy are not responsible for personal belongings lost or forgotten in the vehicle.

COURSE OF DRIVING

The moment the PASSENGER takes his seat in the vehicle and the driver physically starts moving the vehicle towards the agreed destination is defined as the start of the journey. An interruption of the journey between the start and the end destination constitutes a stop, whereby all PASSENGERS leave the vehicle. For journeys of four and a half (4,5) hours or more, two (2) stops of a total duration of forty-five (45) minutes are foreseen. In the case of shorter journeys, the driver shall agree each time with the PASSENGERS on the stop, the first stop, which may last up to 15 minutes, being sufficient if at least one PASSENGER so wishes, and for all subsequent stops the agreement of all PASSENGERS. In the event of too frequent stops at the express request of the CUSTOMERS/PASSENGERS, the DRIVER, the ASSISTANT, the CARRIER and GoCosy shall not be liable for any delays to the final destination. The end of the journey occurs when all PASSENGERS have left the vehicle at the final destination. Only in the case of VIP SHUTTLE OFFERS, the route of travel shall always be the shortest or fastest option, unless otherwise requested by the PASSENGERS for an additional charge. In the case of all other types of transport (FLEX OFFER, COSY OFFER), it is possible that the vehicle stops en route at home addresses, other entry or exit stations and consequently does not follow the most optimal route, which means a longer journey time. In the event of forecasted adverse weather conditions, road works, forecasted congestion, etc., the departure of the vehicle may be up to two (2) hours earlier due to the anticipated longer journey time.

In the case of COSY OFFER or FLEX OFFER, the carriage can be carried out in cooperation of several CARRIERS, which means that the PASSENGER transfers between the vehicles and shifts the luggage.

The driver always has the right to make a stop should he need to do so for the safety of the journey.

CANCELLATION OF THE ORDER BY THE CUSTOMER/AGENT/TRAVELLER

Cancellation of the order by the CUSTOMER/CONTRACTOR/PASSENGER with refund of the money paid is not possible. In the event of cancellation of the COSY OFFER, the FLEX OFFER and the VIP OFFER, no refund of the money paid is possible, to which the CUSTOMER/PASSENGER expressly agrees.

In certain limited cases and amounts, partial or full reimbursement of the purchase price is possible for the COSY OFFER, the FLEX OFFER of carriage and the VIP OFFER of carriage, in accordance with the general conditions of the CARRIER and the Road Transport Act, if the carriage is a regular scheduled service.

The contract of carriage between the CLIENT and GoCosy is not dependent on contracts and agreements that the CLIENT/PASSENGER has with OTHER CARRIERS. In accordance with these General Conditions, in the event of cancellation of the contract for reasons attributable to the CUSTOMER, amounts already paid shall not be refunded by GoCosy.

In the event of cancellation, where there is no cash refund under these General Terms and Conditions, it is possible to obtain a VALUE CODE worth a certain percentage of the purchase already made. This is subject to the cancellation of the order via the GoCosy.com online platform in the myFlex offer tab.

The value of the VALUE CODE depends on the timeliness of the cancellation. The VALUE CODE is not considered as a refund of the amount paid, but as a reward for the correct attitude of the PASSENGER, the CUSTOMER or the ASSISTANT to inform GoCosy that the PASSENGER will not use the service and therefore GoCosy will incur lower costs.

CANCELLATION OF TRANSPORT BY GOCOSA

GoCosy has the right to cancel the carriage in case of closure of the FLEX OFFER route at least 4 days prior to the PASSENGER’S departure and to refund only the paid fare, GoCosy is not liable for any other damages.

GoCosy has the right to cancel the carriage within 72 hours after the purchase has been made if it is determined that there is an error in the ordering system. In this case, the purchase price will be refunded and GoCosy will not be liable for any other damages.

GoCosy shall always have the right to cancel the carriage, without refund of the purchase price, if it is established that there has been an abuse of the programme/ordering system by the CUSTOMER/CONTRACTOR/PASSENGER.

VEHICLE BREAKDOWN AND OTHER EXTRAORDINARY INTERRUPTIONS TO THE JOURNEY FOR WHICH THE PASSENGER IS NOT RESPONSIBLE

In the event of a breakdown of the vehicle, the CARRIER undertakes to provide replacement transport. If a replacement vehicle cannot be provided within four (4) hours of the interruption of the journey due to the breakdown, the CARRIER shall reimburse the CUSTOMER for the fare paid and shall add a VALUE CODE in the amount of the value paid. The CUSTOMER/PASSENGER shall not be entitled to reimbursement of other costs or any compensation in the event of a breakdown of the vehicle.


 If the carriage is interrupted due to other extraordinary causes for which the PASSENGER is not responsible (other than force majeure), the PASSENGER shall have the right to demand that the CARRIER transport him/her and his/her luggage to the place of departure within a reasonable period of time and reimburse him/her the fare, or to withdraw from the contract and demand reimbursement of the fare from the CARRIER. In either case, the CARRIER shall refund the fare paid to the CUSTOMER and shall add a VALUE CODE equal to the value of such fare paid. The
CUSTOMER/PASSENGER shall not be entitled
to reimbursement of other costs or any compensation
in the event of other extraordinary interruptions of the journey.

OUT

Delays of the PASSENGER(S):

GoCosy is not obliged to wait for the PASSENGER in case of delays of OTHER CARRIERS and in case of prolonged delays of OTHER CARRIERS, the contract between GoCosy and the CUSTOMER is terminated. Pri izbiri URE ČASA ODHODA zamuda POTNIKA zaradi zamude DRUGEGA PREVOZNIKA pri COSY PONUDBI ali FLEX PONUDBI prevozu ne sme preseči okna fleksibilnosti pri enem od POTNIKOV v istem vozilu za uro in pol pri relacijah nad 150 km oziroma za 30 minut pri relacijah pod 150 km. The maximum waiting time is 6 hours. In the case of a VIP OFFER, the delay of the PASSENGER due to the delay of the OTHER CARRIER may be up to 3 hours for routes above 150 km or 1 hour for routes below 150 km. The above also applies in the event of other unexpected changes such as: diversion of the arrival of the aircraft to another airport, delay of the aircraft due to incorrectly entered EARLY ARRIVAL TIMES or DEPARTURE TIMES. If the PASSENGER is delayed even though the OTHER CARRIER has already arrived, the waiting time is up to 15 minutes after the scheduled departure time. If the DELAY OF THE PASSENGER does not depend on the OTHER CARRIER, the waiting time shall be 5 minutes from the time specified in the message.

Delays for which the CARRIER is liable

In the event that the CLIENT has correctly entered the TIME OF EARLIEST ARRIVAL, but the PASSENGER misses the onward carriage with the OTHER CARRIER due to the late arrival of the carriage organised by the CARRIER and the delay is not caused by external unforeseeable circumstances beyond the control of the CARRIER (force majeure), nor by the CLIENT’s/PASSENGER’s request for multiple stops, the CARRIER shall refund to the CLIENT the fare paid and shall add a VALUE CODE equal to the amount of this value paid. The CUSTOMER/PASSENGER shall not be entitled to any other reimbursement or compensation.

The CARRIER shall be entitled to minor delays of up to two (2) hours, which may be caused by waiting for other passengers whose flights are delayed, traffic and other unforeseeable factors.

HIGHER POWER

In the event of inability to carry out the carriage or interruption of the carriage due to force majeure (traffic congestion, bad weather conditions, etc.) and when it is therefore not possible to continue the journey in time, GoCosy and the CARRIER shall not be liable for the damage caused, nor shall they reimburse the money paid for the carriage.

SAFETY, PASSENGER OBLIGATIONS AND RESPONSIBILITIES, AND PROHIBITIONS CONCERNING THE CONDUCT OF PASSENGERS ON BOARD

All vehicles used by GoCosy for transport are licensed for the carriage of passengers, are duly insured and inspected and comply with the applicable legislation of the Republic of Slovenia. CARRIERS shall use vehicles for transport which comply with the requirements of the local legislation in force for the carriage of passengers by road. The accident insurance of the PASSENGERS is included in the price of the carriage.

In the event of inappropriate behaviour by PASSENGERS which may cause injury to themselves or others, or cause a high degree of discomfort and disgust to other PASSENGERS, the driver must stop the journey and ensure the safety of other PASSENGERS and the vehicle before continuing the journey. In the event of inappropriate behaviour, the driver shall remove from the vehicle the person whose behaviour endangers and disturbs other PASSENGERS. A PASSENGER in the vehicle shall not open the doors while driving, throw objects at or from the vehicle, obstruct other PASSENGERS getting on and off the vehicle, smoke, destroy or dispose of equipment or pollute the vehicle.

The CLIENT/PASSENGER shall be liable for damages for breach of this prohibition in accordance with the law. No dangerous objects, in particular firearms, explosive, flammable or corrosive substances or objects which may impede the normal movement of PASSENGERS or cause damage to PASSENGERS or their property, may be taken on board the vehicles.

EXCLUSION OF THE PASSENGER FROM THE CARRIAGE

The CARRIER shall not be obliged to accept for carriage a PASSENGER whose conduct may reasonably be expected to prevent the CARRIER from fulfilling its obligations towards other PASSENGERS. The CARRIER may exclude from carriage a PASSENGER whose behaviour is harassing to other PASSENGERS or who does not respect the rules of law and order. In such case the CARRIER shall not be obliged to refund the fare to the PASSENGER. The CARRIER shall not permit a person to enter the vehicle or shall remove from the vehicle a person who is violent or annoying to other PASSENGERS, whose behaviour constitutes a danger to the journey or to the PASSENGERS or who wishes to bring unsuitable luggage or dangerous substances into the vehicle.

COMPLAINTS

The CUSTOMER/PASSENGER may complain about the quality and manner in which the transport service is provided. The complaint shall be made by the CUSTOMER/PASSENGER in electronic form directly to the CARRIER within 15 days of the carriage. The CARRIER shall respond to the passenger’s complaint within 14 days of its receipt.


 The complaint should be sent to admin@GoCosy.si. If the complaint is justified, GoCosy will refund the CUSTOMER part or all of the fare paid and additionally grant a VALUE CODE for any future purchases.

CARRIER’S LIABILITY

The CARRIER shall be liable for damages resulting from an accident during carriage as a result of death, impairment of health or injury of the PASSENGER in accordance with the applicable regulations under the compulsory insurance of PASSENGERS in road transport.

The CARRIER shall not be liable for damages resulting from death, impairment of health or injury of the PASSENGER if the cause of the damage was not attributable to the CARRIER, as well as if the damage was caused by the actions of the PASSENGER or by a cause beyond the control of the CARRIER – force majeure.

The CARRIER shall be liable for damages for loss of or damage to properly delivered luggage in accordance with the provisions of the Road Transport Contracts Act.

The CUSTOMER/PASSENGER or the beneficiary must make a claim for compensation for any damage within 15 days of the cause of the damage.

COMMERCIAL CONFIDENTIALITY

GoCosy will treat all data and information arising out of or in connection with the performance of contracts as a business secret. This provision does not apply to information that must be disclosed to persons and authorities entitled to do so under applicable law.

PROTECTION OF PERSONAL DATA

The CUSTOMER/PASSENGER authorises GoCosy and consents to the collection, storage, processing, use and transfer of his/her personal data in connection with all GoCosy processes. GoCosy undertakes to protect all personal data of the CUSTOMER/PASSENGER in accordance with the applicable legislation governing the protection of personal data.


 The CUSTOMER/PASSENGER agrees that GoCosy
may use the personal data provided by the CUSTOMER/PASSENGER for the purposes of the performance of the service and statistical processing.

By accepting these General Terms and Conditions, the CUSTOMER/PASSENGER who makes a reservation agrees to the use of the data provided for marketing and business purposes. GoCosy may use the data itself or hire external contractors for this purpose, to whom it may provide the data by means of a contract in which it protects the personal data provided in the same way.

FINAL PROVISIONS

The parties shall endeavour to resolve any disagreements amicably; in the event that this is not possible, the parties agree that the Ljubljana Court shall have jurisdiction. In the event of a dispute, the version of the General Terms and Conditions in the Slovene language shall prevail. The law of the Republic of Slovenia shall apply to the interpretation of the General Terms and Conditions.

In the case of scheduled transport, the Carrier’s General Conditions of Carriage for the carriage of passengers and luggage by scheduled road transport and the Road Transport Act or local legislation shall apply. In the case of foreign OTHER CARRIERS, the relationship between the passenger and them shall also be governed by local regulations which must be complied with by the GOCOSY, the INTERMEDIATE, the CUSTOMER and the PASSENGER.

The currency of the transaction under these General Terms and Conditions shall be the EURO and all purchases shall be made in the currency of the transaction, regardless of the currency in which the Customer has made the transaction. The VALUE CODE obtained by the PASSENGER/CUSTOMER shall be valued in the currency of the transaction.

GoCosy reserves the right to change these General Terms and Conditions at any time.

The General Terms and Conditions shall come into force on the day following their publication on the website www.GoCosy.si, i.e. on 7 October 2023, at which time the previous GoCosy General Terms and Conditions shall cease to apply.
